Pete,

It was specified in section 6.3 of H.450.1 specification

-       a FACILITY message shall not be sent if a SETUP message previously
sent or received has not been answered.

I stand corrected...

I thought I read an e-mail a while back that didn't allow you to send
facility before a certain stage in the call setup process.  After searching
I can't find it, and the context might have been different anyway (i.e.
Sending SETUP and then SENDING Facility, rather than sending SETUP and then
RECEIVING Facility.)

I'm happy now!
